Terms of Service

Welcome to Sober AF Dating ("Sober AF", "we", "us", "our"). These Terms of Service ("Terms") are a binding agreement between you and us. They govern your use of the Sober AF Dating mobile app, our websites and any related services (together, the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

To use the Service you must:

• be at least 18 years old (or the age of majority where you live, if higher);
• be legally able to enter into a binding contract;
• not be barred from using the Service under the laws of your country; and
• not have been convicted of, or be required to register as a sex offender for, any sexual or violent crime.

We have zero tolerance for minors on the Service. Accounts we believe belong to someone under 18 are removed. See our Child Safety Standards.

2. Your account

• You can sign up with your phone number, email, Google or Apple. Keep your login credentials secure — you are responsible for all activity on your account.
• Provide accurate information and keep it up to date. You may hold only one account and may not impersonate anyone.
• You can join as a member looking to date, or as a supporter ("Friends & Supporters of Sober AF"). Supporter profiles are not shown for dating.
• You can delete your account at any time from Settings in the app. Deletion is permanent; see the Privacy Policy for what happens to your data.

3. Age & identity verification

To keep the community safe we may ask you to verify your age or identity, including through our verification partner Yoti. Verification may use a selfie or an identity document. If you decline or fail verification, we may limit or close your account. Verification does not mean we endorse or guarantee any member.

4. Community rules

Sober AF is a community for people living alcohol- and substance-free lives and those who support them. When using the Service you agree that you will not:

• harass, threaten, bully, stalk, intimidate or defame anyone;
• post or send hateful, discriminatory, violent, sexually explicit or otherwise objectionable content;
• share nudity or sexual content involving anyone, or any content that sexualises minors;
• promote, sell or encourage the use of alcohol, drugs or other substances, or pressure anyone in recovery to use;
• solicit money, run scams, romance fraud or pyramid schemes, or advertise or promote commercial services;
• post someone else's private information or images without their permission;
• impersonate another person or use photos that are not of you;
• use bots, scrapers or automated means to access the Service, or interfere with its security or operation;
• reverse engineer, copy or resell any part of the Service; or
• use the Service for anything illegal.

5. Your content

"Your content" means anything you add to the Service — photos, videos, reels, stories, profile answers, endorsements and messages. You keep ownership of your content. By posting it, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, process, re-encode, display and distribute it for the purpose of operating, improving and promoting the Service. This licence ends when you delete the content or your account, except where it has been shared with others (for example, messages already delivered) or where we must keep it for legal reasons. This licence is subject to your rights under data protection law, including where your content contains your personal information.

You are responsible for your content and confirm you have the rights to share it. We may remove any content that breaks these Terms.

6. Safety & meeting in person

We do not conduct criminal background checks on members and cannot guarantee anyone's identity, intentions or sobriety. You are solely responsible for your interactions with other members. When meeting someone:

• meet in a public place and tell a friend where you are going;
• arrange your own transport and stay in control of your own drink;
• never send money or financial information to someone you have met on the Service;
• report anyone who makes you feel unsafe — and if you are in danger, contact local emergency services.

The Service is not a substitute for professional medical, mental-health or addiction treatment. If you are struggling, please reach out to a qualified professional or a local support line.

7. Features

• Discover, likes & matches. Members are shown to you based on your preferences and location. Daily limits on swipes, likes and super-likes may apply and can change.
• Chat. Messages between matches, including voice notes, photos and GIFs. Some chats are end-to-end encrypted.
• Reels & stories. Short videos and stories you share are visible to other members as described in the app.
• Double Date (Duo). You can pair with a friend and match with another pair. Everyone in a Duo room can see messages posted there.
• Endorsements. Friends and supporters may write endorsements for your profile. You control which ones are shown.

We may add, change or remove features at any time.

8. Subscriptions & purchases

• Premium subscriptions are sold through the Apple App Store or Google Play and are billed to your store account.
• Subscriptions renew automatically at the end of each period at the then-current price, unless you cancel at least 24 hours before renewal.
• You can manage or cancel a subscription in your App Store or Google Play account settings. Deleting the app or your account does not cancel a subscription.
• Refunds are handled by Apple or Google under their policies. Except where required by law, payments are non-refundable.
• Prices and what is included in each plan are shown in the app before you buy and may change; we will give notice of price changes as required by law and by the store.

9. Donations

You may choose to make a voluntary donation through the app. Donations are processed by our payment provider, Stripe. Donations are optional, do not unlock any feature, and are non-refundable except where required by law. Unless we tell you otherwise in writing, donations are not tax-deductible.

10. Moderation & termination

We may review, remove or restrict content, and suspend or permanently ban any account, if we believe you have broken these Terms, put others at risk, or exposed us to legal liability. Where appropriate we will tell you why. If your account is terminated, any unused paid time is not refunded except where required by law. You may stop using the Service and delete your account at any time. Sections 5, 12–15 survive termination.

11. Third-party services

The Service relies on third parties such as Apple, Google, Firebase, Yoti, Stripe and GIPHY. Your use of their services may also be subject to their own terms. We are not responsible for third-party services, websites or content.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT PROMISE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE, OR THAT YOU WILL FIND A MATCH. WE ARE NOT RESPONSIBLE FOR THE CONDUCT OF ANY MEMBER, ON OR OFF THE SERVICE.

13. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE OR YOUR INTERACTIONS WITH OTHER MEMBERS. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR £100. Some jurisdictions do not allow these limits, so they may not apply to you in full.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded under the law of England and Wales.

14. Indemnity

You agree to indemnify and hold us harmless from any claims, losses and expenses (including reasonable legal fees) arising from your content, your conduct, or your breach of these Terms.

15. Disputes & governing law

Please contact us first — most concerns can be resolved informally. These Terms are governed by the law of England and Wales, and any dispute will be heard in the courts of England and Wales. If you live in Scotland or Northern Ireland, or elsewhere and the law of your country of residence gives you the right to bring a claim locally, you may also bring a claim in your local courts. Nothing in these Terms limits rights you have as a consumer that cannot be waived.

16. Changes to these Terms

We may update these Terms from time to time. If a change is material we will notify you in the app or by email before it takes effect. Continuing to use the Service after the change means you accept the updated Terms.
